Feds claim state law unconstitutionally supersedes Congress.
On Wednesday, the Department of Justice filed a lawsuit against Texas for its Senate Bill 4, which allows state officials to arrest and prosecute illegal immigrants outside of federal powers.
“Under the Supremacy Clause of the Constitution and longstanding Supreme Court precedent, states cannot adopt immigration laws that interfere with the framework enacted by Congress,” Associate Attorney General Vanita Gupta stated. “SB 4 is clearly unconstitutional.”
The state of Texas is also currently suing the federal government regarding the removal by U.S. border agents of razor wire fencing on private property along the U.S.-Mexico border.
